This document describes the general conditions of use of Gratis-immo.ch. It should be read carefully.

1. Acceptance of the conditions

2. Role of Gratis-immo.ch

Gratis-immo.ch acts as an independent service that brings together people who wish to buy, sell, gift or exchange real estate. We therefore do not own and we do not occupy the properties offered in the advertisements. We are consequently unable to inspect or guarantee the quality, security or legality of the advertisements and the content published on Gratis-immo.ch.

3. Obligation of the users

Gratis-immo.ch is a passive publisher of your advertisement on-line as well as messages from forums. You are consequently responsible for the information that you provide.
Your information (or contents) include all the information that you supply to Gratis-immo.ch or to other members during the registration process, the transactions and the publication of the advertisements. This includes the text as well as the images.

You accept that Gratis-immo.ch is not able to view and inspect the advertisements and the messages from forums before they appear, but that Gratis-immo.ch may (without obligation) reject, change and reorganise all the content supplied.

Moreover, Gratis-immo.ch reserves the right to suspend, block or cancel your account, at any time and at its own discretion, and to refuse all present and future use of its services, irrespective of the reason.
Gratis-immo.ch reserves the right to change, temporarily or permanently, all or part of its services at any moment and without prior notification.

4. Content published on Gratis-immo.ch

You warrant that the contents that you post on Gratis-immo.ch are:

• Not prohibited under the conditions for the advertiser
• Not prohibited under the conditions of use of the forums
• Realistic and up-to-date
• Not fraudulent and do not concern a stolen property
• In accordance with the law in force in Switzerland
• Not defamatory
• Not obscene and do not contain any child pornography or any form of public indecency
• With respect to
  
  • the conditions of use of Gratis-immo.ch
  • the principle of protection of privacy
  • the conditions for the advertiser
  • the conditions of use of the forums
  • the various guides provided on the site of Gratis-immo.ch.

5. Licence

You agree to assign to us a non-exclusive, international, perpetual, irrevocable right to use the copyright, without royalties, and to use the public right (and not other rights) that you have to the content of your advertisements, irrespective of the media, and whether they are known or not known at present.

6. Data protection

Gratis-immo.ch processes personal data in accordance with the principles of privacy and data protection.

7. Using Gratis-immo.ch for a transaction

The advertisements consist of descriptive texts, graphics and/or images. They describe:

• a property that you are offering;
• a property that you are looking for.

You have the option of placing these two types of advertisement on Gratis-immo.ch, provided that the category that is selected is appropriate.
Gratis-immo.ch is not responsible for the truthfulness and the content of the advertisements.
All advertisements are subject to acceptance by Gratis-immo.ch.

8. Disagreement between users

Gratis-immo.ch does not intervene in disagreements or conflicts between users.

9. The transaction system

You agree never to use any tool, software or procedure whatsoever that would impair or potentially impair the smooth running of Gratis-immo.ch, transactions between users or the forums.
You are also banned from doing anything on Gratis-immo.ch that will place an unreasonable or disproportionate burden on the infrastructure.

10. Conditions of providing the service

We endeavour to do our utmost to make your experience on Gratis-immo.ch as enriching and pleasant as possible. We are, however, unable to foresee or predict all the technical problems or other types of problems that may occur.
These problems may result in data loss or disruptions to the service.

You therefore accept that Gratis-immo.ch provides the services “as are”. We consequently do not assume responsiblity for any loss of time, data, money, opportunity or business deal. 

GRATIS-IMMO.CH AND ITS PARTNERS PROVIDE THE WEBSITE GRATIS-IMMO.CH AND THE SERVICES AS ARE, WITHOUT ANY GUARANTEE WHATSOEVER.

11. Blocking or cancellation of access or document

We may issue a warning, temporarily suspend or cancel an account, an advertisement or any other type of information on the site at any time, if it fails to comply with the conditions of use or other rules issued by Gratis-immo.ch.
Furthermore, Gratis-immo.ch is entitled at any time, and at its own discretion, to suspend, block or cancel your account and to refuse you all present or future use of its services if it transpires that you have used Gratis-immo.ch to engage in fraudulent activities.

12. Limitation and exemption from liability

The procedure for placing classified advertisements is largely automated. Gratis-immo.ch is unable to view all the classified advertisements. Gratis-immo.ch is consequently unable to accept any liability for the content of the classified advertisements included on its pages or for any error or omission in the classified advertisement, or any content that is not objective, whether lawful or unlawful, that is disseminated on the website.

LIABILITY ON THE PART OF GRATIS-IMMO.CH FOR ACTUAL OR CONSEQUENTIAL DAMAGE RESULTING FROM MINOR OFFENCES - IRRESPECTIVE OF THE LEGAL BASIS - IS EXPRESSLY EXCLUDED, EXCEPT FOR MANDATORY LEGAL PROVISIONS.

LIABILITY ON THE PART OF GRATIS-IMMO.CH FOR ACTUAL OR CONSEQUENTIAL DAMAGE IS – IRRESPECTIVE OF THE LEGAL BASIS – EXPRESSLY AND TOTALLY EXCLUDED. GRATIS-IMMO.CH DOES NOT ASSUME ANY LIABILITY FOR ANY LOSS SUFFERED BY USERS OR BY THIRD PARTIES AS A RESULT OF THE BEHAVIOUR OF OTHER USERS.

13. Compliance with Swiss laws

The user shall comply with Swiss laws at all times when using the service, negotiating, buying, selling, exchanging or gifting property.

14. Place of jurisdiction

The place of jurisdiction is Lausanne (Vaud).
